TERMS AND CONDITIONS

Definitions:

In this document the following words and phrases shall have the meanings as setout herein below unless the context indicates otherwise.  

a)         “Bank” refers to Vijaya Bank, a banking company incorporated in India under the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1980 and having its Head Office at 41/2, M. G. Road, Bangalore-560001, and may include its successors, assigns and nominees.              

b)         “User” refers to customer of Vijaya Bank who is authorized to use Bank’s Internet Banking Services.   

c)           “Services” refers to all the services provided by the BANK to the User through the Bank’s Internet Banking Services., christened as VNET Banking. The word Internet Banking and Internet Banking Services will be used interchangeably and would mean VNET Banking and the services offered through VNET Banking unless the context indicates otherwise.  

d)         “Account” refers to the User’s Savings and/or Current account and/or any other type of account for which operations are allowed by the Bank through Internet Banking. The same shall include all the operative and other accounts of the User linked to the Internet Banking services.  

e)         "Personal Profile” refers to the User’s personal information such as Name, Address, Phone number, E-mail ID, Mobile no etc.  

f)          "Terms” refers to the Terms and conditions prescribed by the Bank from time to time for using the Internet Banking Services.  

g)         "User Id” means the identification code allotted to and specific to the User, which is necessary to access the Internet Banking Services.  

h)         "Sign On Password” is a unique security code generated by the Bank to each user initially, which has to be changed by user on First Login. This Sign on Password so changed as above, along with User Id should be used to log in to Internet Banking Services.

i)           “Transaction Password” is a unique security code generated by the Bank to each user, which has to be changed by user on First Login and used by the user while executing financial transactions like Funds transfer etc., and Semi-financial transactions like issuing Stop payment instructions etc.

j)           "Technical Problems" include any problems and difficulties arising due to power and electricity failure, computer errors, virus related problems, programming errors, software or hardware errors, computer breakdown, non-availability of Internet connection, communication problems, shutting down of the Bank's server, non-availability of links, corruption of the system software, problems in other Utility Companies extending support to Bank, breakdown of infrastructure and telecommunication network, problems in any other connected telecommunication network and any other technology related problems.

k)         "Website" refers to the website owned, established and maintained by Bank located at the URL www.vijayabankonline.net   

l)           In this document all references to the user being referred in masculine gender shall be deemed to include the feminine gender.            

 2. Applicability of Terms          

    These Terms form the contract between the user and Bank for availing Internet Banking Services. The customer of any of the Core Banking Branches can apply in a specified application form prescribed by the Bank for the Internet Banking Services. These forms should be properly and fully filled up and submitted to the branch where the customer maintains his account. By applying for Internet Banking Services and accessing the service, the customer acknowledges and accepts these TERMS and Conditions. The agreement shall remain valid until it is replaced by another agreement or terminated by either party or the account is closed, whichever is earlier. Bank shall be entitled at its sole discretion to accept or reject such applications as may be submitted by the customers. The BANK may advise the user from time to time the changes in the software/options in the software. User represents and warrants that he / it / they has / have a complete working knowledge of computers / electronic machinery, e-mail and the Internet, which will enable him / them to avail the SERVICES. However, where there is any discrepancy, in the terms stipulated by the bank elsewhere for any of the services and the terms herein, the terms and conditions herein shall prevail for the purposes of services.  

 3. Internet Access          

    For the purpose of availing Internet Banking Services, the user would need to have legal and valid access to the Internet.  

 4. Internet Banking           

    The user cannot claim the SERVICES as a matter of right. The BANK shall take reasonable care to ensure the availability of the SERVICES round the clock. The BANK reserves the right to refuse /withdraw the facility provided to the user without assigning any reason. The BANK at its sole discretion may also make additions / deletions to the Services. The bank has the right to determine and vary from time to time without prior intimation, the scope and type of services to be made available including, expanding, modifying or reducing the services at any time and prescribing and changing the normal service hours during which the services are available and any daily cut-off time for any type of services. Any instruction of the user received by the bank after any applicable daily cut-off time shall be deemed to have been received on the next business day.  

The Bank will advise from time to time the Internet software such as Browsers, which are required for using VNET Banking. There will be no obligation on the Bank to support all the versions of this Internet software. The users shall be responsible for upgrading software, hardware and the operating system at their own cost from time to time so as to be compatible to avail the SERVICES. The Bank shall be at liberty to change, vary or upgrade its software, hardware, operating systems, etc., from time to time and shall be under no obligation to support the software, hardware, operating systems used by the users.  

The SERVICES are offered FREE initially. The BANK reserves the right to prescribe Fee/Charges for the SERVICES after intimating to the user through the Internet Banking Home page or any other mode. The user will have the option to continue availing the SERVICES paying the prescribed FEE/Charges.  

                 

The user shall be liable to pay all charges, fees, interest, costs wherever applicable, which the Bank in its absolute discretion may levy with respect to any of the SERVICES and the same may be recovered by the Bank by a debit to the user’s account/s.

The user can contact our customer representative cell through telephone for clarifying any of their queries. By accepting these TERMS & Conditions, it will be considered that user has given his consent to recording of any Tele conversation between Bank & customer representative cell.

The Bank may keep its records of the transaction in any form. In the event of any dispute the Bank’s records shall be binding on the User as a conclusive evidence of the transactions carried out by him through Internet Banking.  

 5. Unauthorised Access          

The user shall take all necessary precautions to prevent unauthorized and illegal use of Internet Banking and unauthorized access to the Accounts provided by Internet Banking. Bank shall take all commercially reasonable care to ensure the security of and to prevent unauthorised access to the Internet Banking using commercially reasonable technology available in India.  

6. Internet Banking Access          

The user would be allotted an Internet Banking User Id and a set of secret passwords namely Sign-on Password and Transaction Password by Bank initially. It is mandatory to change the passwords assigned by the Bank on accessing the Internet Banking at first login. The Sign-on Password and Transaction Password will be generated and sent to the User through a PIN Mailer. On receipt of the acknowledgement from the user for having received the Passwords, the BANK will enable the Internet account for the user. It is the responsibility of the user to change the passwords assigned by the BANK for the first time and thereafter shall change the passwords as frequently as possible or at the frequency prescribed by the Bank as a safety measure. The changed Passwords should be at least of eight characters.  

 If a user keys-in the Passwords 3 times wrongly, then the SERVICES will be disabled to that user. The BANK can enable the services only on a written request from the user. BANK will generate a fresh Password to the user and send it to him by PIN mailer.  

The Login Password and Transaction Password are required by the user to access and utilize the SERVICES. The same are strictly confidential and not transferable. The user under any circumstances should not disclose these passwords to any third party. The user shall be responsible for all type Transactions executed using the above Passwords. The BANK shall have no obligation to verify the authenticity of any transaction received through the SERVICES other than the system verification of user ID and Passwords. The user will be wholly responsible for the secrecy of the Passwords and the BANK bears no liability for any use of the facility by an unauthorized person. The BANK on a written request by the user will set the Passwords again and send the same to the User through PIN Mailer.  

                 

The Bank will send User Id & Passwords through separate Mailers. The User ID mailer will contain an acknowledgement. The User on receipt of both User Id & Passwords in sealed conditions has to send back the acknowledgement duly signed by him, to the Bank. The user Account will be enabled for Internet Banking Services only after receiving the acknowledgement.  

The User will be responsible for all transactions done through the Internet Banking and such transactions will be considered as Transactions originated by the User and will be binding on the User.  

If the user forgets the Internet Banking Password, the user may request for the issue of a new password by sending a written request to bank and this shall not be construed as the commencement of a new contract. The user agrees and acknowledges that Bank shall in no way be held responsible or liable if the user incurs any loss as a result of information being disclosed by Bank regarding his Account(s) or carrying the instruction of the user pursuant to the access of the Internet banking and the user shall fully indemnify and hold Bank harmless and free from any liabilities in respect of the same.  

 7. Account Services          

User can access all accounts related to his Customer ID. When user opens a new account under the same Customer Id, the new account will be available for access through Internet Banking on next working day. Closed account will move to closed accounts category on next working day of closure. The User shall at all times maintain the minimum balance in the accounts stipulated by the BANK from time to time. The Bank at its discretion can levy penal charges for not maintaining these stipulated balances in the account. If the account is overdrawn inadvertently or due to technical problems, the user will be obliged to reimburse the overdrawn amount and pay the interest and other charges on the overdrawn amount as decided by the BANK.  

The report generated by the user through the SERVICES is a record for having executed the transactions and shall not be construed as Bank’s record of the relative transactions. The Bank’s own records of transactions maintained by the BANK shall be accepted as conclusive and binding for all purposes.  

The information available for some of the queries is based on off-line data uploaded from the Core Banking Database. So such data available on the site may not be the data as on point-of-access. It may display one-day-old data.  

BANK under no circumstances shall be held liable to the user if the SERVICES are not available in the desired manner for reasons including but not limited to technical problems, natural calamities, flood, browser incompatibility, failure in Telecommunication network or any other reason.  

 8. Funds Transfer          

The User shall be responsible for keying in / select correct account number for the Funds Transfer Request. Bank shall not be held liable for any erroneous transactions incurred due to or related to user entering or selecting wrong account number.  

                 

The Bank will affect scheduled fund transfer subject to availability of enough funds in the related account. The bank is not liable for any omission in the Funds Transfer due to circumstances beyond the control of Bank.  

The Bank will not be liable for any omission to make all or any of the payments or for late payments due to circumstances beyond its control.  

In the event of overdraft created due to oversight/inadvertently, the user will be liable to repay the same with interest on such overdrawn amount at such rates as may be decided by the BANK from time to time.  

Once the Bank receives the instructions from the user for making any payment through the Bank Account, the Bank shall have the authority to debit the user’s Bank Account with the payment and any charges (including any service tax) applicable for the transaction. The Bank shall also have the authority to debit the Bank Accounts to recover any amount credited erroneously to the user’s accounts.  

On-line payment/Funds Transfer will be effected instantaneously once the user commits the transaction in the Internet Banking Menu. User shall check the status of the fund transfer / payment request immediately. The on-line payments made after business hours of the remitter branch will be effected on next working day with proper value date.  

The Bank reserves the right to charge a fee to the user for use of Funds Transfer facility through Internet Banking.  

 9. Stop Payments  

The Bank will record stop payment instructions received from the user regarding cheques, which have been lost, stolen etc provided the Bank makes such facility available. The stop payment order will become effective from the date and time indicated at the time of acknowledgement and will remain effective unless cancelled. Bank shall not be liable if the Bank has made the payment of such cheque prior to the effective time and date indicated therein.  

Bank reserves its right to refuse to carry out an instruction given by the user or the Bank may require written confirmation from the user regarding a particular instruction, if the Bank were to come to believe that the instruction may not have been properly authorised by user or if the transaction is purported to be a fraudulent transaction or not permitted by Law. Bank may also take reasonable steps to check whether the transaction was permitted under Law and may reverse any action taken on the instruction given by the user. However, the Bank shall not be liable for any loss resulting out of such reversal or failure to carry out the transaction.   

Bank shall not be under any obligation to reverse the instruction given or to accept an instruction that is conditional or reversible or which requires the Bank to pay a Third Party sooner than it would be able to pay them following its normal banking practices. However, if the user requests the Bank to reverse an instruction after it has been given, the Bank may at its discretion try to do so to the extent that this is possible under the rules and practices of the banking system. Users agree that they shall be responsible for any costs that the Bank may incur as a result thereof.   

At the user's request, the Bank may send to the user by fax (at a fax number given by the user) financial information (sought by the user) regarding the user’s Account(s) which may be of a private and confidential nature and the user shall not hold the Bank liable in any manner whatsoever, should such information come to the knowledge of any third party.  

10. Remittance to the account holders in other Banks    

User will utilize this option to remit amount to a beneficiary having an account with other Banks. User shall enter payment details with all the particulars sought in the related screen. User shall be responsible for the accuracy of the particulars given in the payment details and shall be liable to compensate the Bank for any loss arising on account of any errors committed in entering the payment details.   

User hereby authorizes the Bank to debit to his account any liability incurred by him to the Bank for execution by the Bank of any payment order issued by him.  

User agrees that he shall not be entitled to make any claim against any party in the RBI EFT System except the Bank.  

User agrees that in the event of any delay in the completion of the Funds Transfer or any loss on account of error in the execution of the Funds Transfer pursuant to a payment order, the Bank's liability shall be limited to the extent of payment of interest at the Bank Rate for any period of delay in the case of delayed payment and refund of the amount together with interest at the Bank Rate up to the date of refund, in the event of loss on account of error, negligence or fraud on the part of any employee of the Bank.  

User agrees that no special circumstances shall attach to any payment order executed under the e-remit facility as per the terms & conditions stated herein and under no circumstances user shall be entitled to claim any compensation in excess of that which is provided in clause above, for any breach of contract or otherwise.  

User hereby authorizes the Bank for on-line debiting of the account to remit the funds to the beneficiary specified by him as per details furnished. On-line debit of the user will be affected instantaneously once the user commits the transaction in this menu.  

User shall be bound by the payment order executed by the Bank in good faith and in compliance with the security procedure, provided that the user shall not be bound by any payment order executed by the Bank if he proves that the payment order was caused either by negligence or a fraudulent act of any employee of the Bank.  

The payment order will not be executed if the funds available in the account of the user are not adequate or properly applicable to comply with the payment order along with the charges if any.

 

If the payment order is to be executed through RBI’s EFT/ECS/RTGS system, and if for any reason, the services from RBI is not available, then the payment instruction will not be executed and the BANK shall not be held responsible for the loss in such case. If Remittance is received after the cut-off time fixed by RBI, then such transactions will be executed on the next working day.

The payment order will not be executed if the BANK has a reason to believe that the payment order is issued to carry out an unlawful transaction.  

 11. Joint Accounts          

 Internet Banking will be available in case of joint accounts, only if the mode of operation is indicated as ‘either or survivor’ or ‘anyone or survivor’ or ‘former or survivor’. For ‘former or survivor’ account, user-id will be issued only to the ‘former’. For ‘either or survivor’ and ‘anyone or survivor’ accounts one user-id will be issued to one of the joint account holders. The other joint account holder(s) shall expressly agree with this arrangement and give their consent on the application form for use of Internet Banking Services. In case of ‘either or survivor’ and ‘anyone or survivor’ accounts if any of the joint account holder(s) gives “stopping of operations” instructions for the use of Internet Banking service in writing, on any of the Internet Banking Service accounts held jointly by them, the Internet banking Services will be discontinued for the user. In case of ‘former and survivor’ account, other account holder can not issue such instructions.  

 12. Requests for DDs  

User hereby authorises the Bank for execution of electronic instructions for debiting his/her account for the amount specified in "DD amount" field plus charges as applicable & issue of DD favouring the payee specified by the user.  

The users shall maintain funds sufficient for issue of DD including Bank charges.   

The DDs are issued with "Account Payee" crossing, on all the Centres where Bank’s branches exist.   

The DDs shall be delivered within 3-4 days (excluding holidays) to the mailing address as per the Bank’s records.   

The DDs issued are valid only for a period of 6 months, beyond which the user has to re-validate/cancel the DD at the issuing branch with a request in writing.  

In case the DD is lost, user shall intimate the issuing branch in writing.  

If the user requires issue of duplicate DD, the user shall contact the issuing branch with a request in writing upon which shall issue duplicate DD on completion of certain formalities like obtaining indemnity letter / (stamped) indemnity bond etc.  

             

 13. Request for Cheque Book  

User shall select appropriate account number and number of leaves required in the Cheque Book.  

User hereby authorises the Bank to debit user’s account for appropriate charges including courier charges if any.  

Bank shall process the request normally within one working day and dispatch the cheque book to the address registered with the Bank.  

If the user does not receive the requested Cheque Book within reasonable time, it shall the responsibility of the user to confirm the fate of the request with the BANK.  

14. Request for Opening Term Deposit / Renewal of Term Deposit  

User shall select account to be debited, choice of deposit, plan period, deposit amount, deposit type, instructions regarding periodical interest and auto-renewal of deposit.  

This will be taken only as a request in a predefined format and the user will enter all the information in full and correctly.  

User hereby authorises the Bank to debit the account selected in order to enable the Bank to process the request for term deposit.   

Bank shall process the request within one working day and dispatch the terms deposit receipt to the user at the address registered with the Bank.  

Actual payment of interest and maturity value is subject to Tax Deduction at Source Provisions of Income Tax Act.  

15. Utility Bill Payment    

Bank has entered / may enter into agreement with Public Utility companies such as Electricity boards, Water supply boards, Telephone service providers, Insurance companies etc for facilitating Utility Bill Payments. Such transactions shall be governed by the agreement between the Bank and the Utility companies. Terms and conditions for usage of such facilities emanating from such agreements shall be legally binding on the user who uses such facilities.   

User shall provide correct identification details assigned by the Utility companies and further agrees to INDEMNIFY the Bank from any liability due to erroneous information, if any, provided in this regard by the User.  

User shall be responsible to communicate the changes, if any, to the Bank about the identification details assigned by the Utility companies, within reasonable time.  

User hereby agrees that he has no objection whatsoever to the Utility companies to provide the billing details to the Bank.  

                 

User keeps the Bank as well as the Utility companies indemnified from and against all actions, claims, demands, proceedings, losses, costs, charges and expenses whatsoever which the Bank and the Utility companies may at any time incur, sustain, suffer as a consequence of providing the user the bill payment facility or by reason the Bank having acted in good faith, taking or refusing to take or omitting to take action on the users' instructions.  

In case the Utility Companies, which mandate the payment of the exact amount before the expiry due date thereof, and any failure of instructions in such cases, the user shall hold the Bank harmless against the consequences thereof and nonpayment of the bill amount, in particular.  

The user will have the option to schedule his payments to Utility Companies on a regular basis, provided the Bank offers such facility.  

The payment to any Utility Companies would be made as per the Bank's arrangement with the Utility Companies and could include a transfer of funds from the user's Bank Account to the Utility Company's Bank Account. In the event the Utility Companies does not have a Bank Account, the Bank will create a "Collection Account" and all payments made by the user will get transferred to the Collection Account, after which the Bank will transfer the payments to the Utility Companies.   

The Bank has the option to levy any service charges for the service provided by the Bank to the user with respect to the Utility Companies, depending upon the agreements entered into between the Utility Companies and the Bank. The Bank shall notify the user regarding such service charges, if any. In cases charges are levied by the Bank, these charges will be reflected in the statement of account sent to the user and no separate receipts will be provided to the user for payments to Utility Companies.   

User shall maintain sufficient funds for payment of bills to Utility Companies on the scheduled date. The Bank shall not be liable to any Utility Companies or Third Party for non-payment of the bills due to insufficient balance or circumstances beyond the reasonable control of the Bank, including any Force Majeure Event or Technical Problems.   

The Bank shall in no way be responsible for the non-payment of the user's bills within the time stipulated by the Utility Companies, if the Bank has taken reasonable care. The user alone shall be bound to pay or discharge interest, penalty or any charges arising out of the non-timely payment. Further, the Bank shall not be called upon to indemnify the user for such interest, penalty or other charges levied.   

The Bank shall not be liable to the user for the suspension / disruption of the services of any Utility Companies due to any Technical Problems or Force Major Event and for any damage / loss caused to the user or any Third Party thereby.   

The Bank shall not be responsible to provide the user with any receipt for payments made to the Utility Companies. All such receipts must be procured directly by the user from the Utility Companies.   

Utility Companies will handle all common user queries relating to product and pricing. Queries relating to receipt of amount and Credit to Utility Companies Account, will only be handled by the Bank.  

 16. Payment to online shopping/ticketing  

Bank has entered / may enter into agreement with virtual shopping malls for online purchasing or with State Transport Corporation, Indian Railways or Airlines companies for online ticket bookings. Such transactions shall be governed by the agreement between the Bank and the shopping malls or Transport companies. Terms and conditions for usage of such facilities emanating from such agreements shall be legally binding on the user who uses such facilities.  

 Bank processes the online payment instantaneously once the user commits the transaction in the Internet banking menu.  

User is supplied with a unique payment reference number after the payment is through, which is to be used for future communication with the BANK regarding the transaction.   

Bank is not liable for any deficiency in service on part of the shopping mall or Transport companies or any matter arising thereof.  

The transaction done through this option is irreversible and any matter regarding cancellation / dispute, the user has to take up the matter directly with the shopping mall/ Transport companies for refund.   

 17. Charges          

Bank reserves the right to charge and recover from the user service charge for providing the Internet Banking. Charges shall be collected from the user in such manner and at such intervals as the bank may decide from time to time.  

 18. Accuracy of Information  

The user is responsible for the correctness of information supplied to the BANK through the use of Internet Banking Services or through any other means such as electronic mail or written communication or Tele conversation with customer representative cell. The BANK shall accept no liability for the consequences arising out of erroneous information supplied by the user. If the user suspects that there is an error in the information supplied to the BANK by him, he shall advise the BANK at the earliest. The Bank will endeavor to correct the error wherever possible on a “best efforts” basis.  

 19. Liability of the user and the BANK  

The user shall be liable for losses accrued due to unauthorized transactions in the account(s) if he has breached the TERMS and conditions or contributed or caused the loss by negligent actions such as the following but not limited to:  

a. In disclosing or failing to take all reasonable steps to prevent disclosure of the User-id and/or passwords to anyone including BANK staff and/or failing to advise the BANK of such disclosure within a reasonable time.  

b. Not informing the BANK with in a reasonable time about unauthorized access to or erroneous transactions in the account(s) through the Internet banking Services.  

The BANK shall not be liable for any unauthorized transactions occurred through the Internet Banking and the user hereby fully indemnifies and holds Bank harmless against any action, suit, proceeding initiated against it or any loss, cost or damage incurred by it as a result thereof.  

The BANK shall not be liable to the user for any damages whatsoever whether such damages are direct, indirect, incidental, consequential and irrespective of whether any claim is based on loss of revenue, investment, production, goodwill, profit, interruption of business or any other loss of any character or nature whatsoever and whether sustained by the account holder(s) or any other person, if Internet Banking Services access is not available in the desired manner for reasons including but not limited to technical problems, natural calamity, floods, fire and other natural disasters, legal restraints, faults in the telecommunication network or Internet or network failure, software or hardware error or any other reason(s) beyond the control of the BANK.  

The Bank shall endeavour to take all possible steps to maintain secrecy and confidentiality of its users’ account(s) but shall not be liable to the account holder(s) for any damages whatsoever caused on account of breach of secrecy/confidentiality due to hacking or technological lapses in the system beyond the control of the Bank.   

 20. Indemnity          

The user shall indemnify and hold the BANK harmless against any loss suffered by the BANK, if any claim or action brought by a third party which is in any way the result of the improper use of Internet banking Services by the user.  

 21. Disclosure of Personal Information  

 The user agrees that the BANK or its agents/associates/contractors may hold and process his Personal Information on computer or otherwise in connection with Internet banking Services as well as for statistical analysis and credit scoring. The user also agrees that the BANK may disclose, in strict confidence, to other institutions, such Personal Information as may be reasonably necessary for reasons inclusive of, but not limited to, the following:  

    i. For participation in any telecommunication or electronic clearing network.  

    ii. In compliance with a legal directive.  

    iii. For credit rating by recognized credit rating agencies  

    iv. For fraud prevention purposes.  

   22. Proprietary Rights        

 The user acknowledges that the software underlying the Internet Banking Services as well as other related software, which are required for accessing Internet Banking Services, is the legal property of the respective vendors. The permission given by the BANK to access Internet Banking Services shall not convey any proprietary or ownership rights in the above software. The user shall not attempt to modify, translate, disassemble, recompile or reverse engineer the software underlying Internet Banking Services or create any derivative product based on the software.  

  23. Change of Terms and Conditions    

    The BANK has the absolute discretion to amend or supplement any of the Terms and conditions at any time and will endeavor to give prior notice of reasonable time for such changes wherever feasible and/or publish the same in the Internet Banking web page of the Bank. Any such notice published in the web page shall be construed as reasonable notice to the User and binding on them. The BANK may introduce new services within Internet Banking Services from time to time. By using these new services, the User agrees to be bound by the terms and conditions stipulated by the Bank from time to time.  

 24. Non-Transferability    

    The grant of Internet banking to a user is not transferable under any circumstance and shall be used strictly by the user.  

 25. Disclaimer of Warranties    

    The applicant expressly agrees that use of the Website is at its sole risk. The Website is provided on an "as is" and "as available" basis.   

  Except as warranted in the Terms, Bank expressly disclaims all warranties of any kind, whether express or implied or statutory, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, data accuracy and completeness, and any warranties relating to non-infringement in Internet Banking.  

 Bank does not warrant that access to the Website and Internet Banking shall be uninterrupted, timely, secure, or error free nor does it make any warranty as to the results that may be obtained from the Website or use, accuracy or reliability of Internet Banking.  

 Bank will not be liable for any virus that may enter the user's system as a result of the user using Internet Banking. Bank does not guarantee to the applicant or any other third party that Internet Banking would be virus free.   

 26. Termination of Internet Banking  

 The User may request for termination of the Internet banking Services facility at any time by giving a written notice of at least 10 days. The termination shall take place on the completion of the tenth day. The User shall remain responsible for any transactions made on her account(s) prior to the time of such cancellation of the Internet Banking Services. The Bank may withdraw the Internet banking facility anytime after giving reasonable notice under the circumstances to the user through the web site. The bank may suspend or terminate the Internet banking Services without prior notice if the user has committed breach of these terms and conditions or the Bank learns of the death, bankruptcy legal incapacity of the user.  

 27. Notices  

 Notices under these terms and conditions may be given by the Bank and the user electronically to the mailbox of both party and such notices will be regarded as being in writing or by delivering the written notices by hand or by sending them by post to the user address as per our records and in case of Bank to the address mentioned below:

Bank may also publish notices of general nature applicable to all users of Internet banking Services on its website such notices shall have the same effect as a notice served individually to each user.  

 28. Governing laws    

These terms and conditions and/or operations in the accounts of the user maintained by the bank and/or the use of services provided through Internet Banking Services shall be governed by the Laws of India. Bank accepts no liability whatsoever, direct or indirect for non-compliance with the laws of any country other than India. The mere fact that a user from a country other than India can access Internet Banking service through Internet shall not be interpreted to imply that the laws of the said country govern these terms and conditions and/or the operations in the accounts of the user through Internet and/or the use of Internet Banking Services.   

 By accepting these TERMS & conditions the User expressly consents and submits to the exclusive jurisdiction of the courts in Bangalore, giving such courts the exclusive power and authority to hear and determine any dispute between the parties of this agreement.  

 The user agrees to abide by prevailing laws in respect of Internet Banking Services applicable in India. It shall be the responsibility of the user to comply with any regulations prevailing in the country from where he is accessing the Internet.  

 29. GENERAL          

    The clause headings in this document are only for convenience and do not effect the meaning of the relative clause. The user shall not assign this agreement to anybody else. The Bank may subcontract and employ agents to carry out any of its obligations under this contract.
